1. Acceptance of Terms

Welcome to Prism Luv! These Terms of Service ("Terms") govern your access to and use of the Prism Luv website, mobile application, and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.

2. Eligibility

To use Prism Luv, you must:

• Be at least 18 years old
• Be legally permitted to use a dating service in your jurisdiction
• Not be prohibited from using the Service under any applicable laws
• Not have been previously banned or suspended from the Service
• Provide accurate and truthful information when creating your profile

By using the Service, you represent and warrant that you meet all of these requirements. We reserve the right to verify your age and identity at any time.

3. Account Registration and Security

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You may not create more than one account. Accounts are personal and may not be transferred, sold, or shared with others.

4. User Conduct and Content

4.1 Prohibited Conduct

You agree NOT to:

• Upload photos containing nudity, sexually explicit content, or images of minors
• Post false, misleading, or deceptive profile information
• Harass, bully, stalk, intimidate, or threaten other users
• Send spam, solicitations, or commercial advertisements
• Use the Service for any illegal purpose or to violate any laws
• Impersonate another person or entity
• Upload viruses, malware, or any malicious code
• Scrape, data mine, or use automated systems to access the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service if you are a convicted sex offender
• Solicit money or financial information from other users

4.2 Content Standards

All content you post must:

• Be appropriate for a dating platform
• Not contain hate speech, discrimination, or offensive material
• Not infringe on anyone's intellectual property rights
• Comply with all applicable laws and regulations

4.3 Content Moderation

We use automated systems and manual review to detect and remove prohibited content, including:

• Nudity and sexually explicit images - Automatically detected and blocked
• Images of minors - Automatically detected and immediately removed
• Hate speech and harassment - Reviewed and removed upon detection

Violations of content standards may result in immediate account suspension or termination without warning.

5. Intellectual Property

5.1 Our Content

All content on the Service, including text, graphics, logos, designs, software, and the "Prism Luv" name and logo, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without permission.

5.2 Your Content

You retain ownership of the content you upload (photos, bio, messages). However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your content for the purpose of operating and promoting the Service.

You represent and warrant that you own all rights to the content you upload and that it does not infringe on any third-party rights.

6. Subscriptions and Payments

6.1 Premium Subscriptions

Prism Luv offers paid subscriptions (Premium and Elite) with additional features. By subscribing, you agree to pay the applicable fees displayed at the time of purchase.

6.2 Billing

• Subscriptions auto-renew unless you cancel before the renewal date
• You authorize us to charge your payment method on each renewal
• Prices may change with 30 days' notice; changes apply to future billing periods
• All fees are non-refundable except as required by law

6.3 Cancellation

You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the unused portion of your subscription.

6.4 Free Trials

New users may receive a free trial of Premium features. If you do not cancel before the trial ends, you will be automatically charged for a subscription. Only one free trial per user.

7. Disclaimers and Limitations of Liability

7.1 No Guarantees

Prism Luv is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• You will find a compatible match or romantic partner
• Our compatibility algorithm is scientifically validated or accurate
• User profiles are truthful, accurate, or current
• Other users have good intentions or will treat you respectfully

7.2 User Interactions

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. We do not conduct background checks on users. Always use caution when meeting people online and in person. See our Safety Guidelines for tips.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISM LUV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Conduct or content of other users
• Unauthorized access to your account or personal information
• Any interruption or cessation of the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Prism Luv, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising out of or related to:

• Your violation of these Terms
• Your use of the Service
• Your content
• Your interactions with other users

9. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At your request

Upon termination, your right to use the Service immediately ceases. We may delete your account and content, but some information may be retained as described in our Privacy Policy.

You may terminate your account at any time by going to Settings → Account → Delete Account.

10. Dispute Resolution and Arbitration

10.1 Informal Resolution

Before filing a claim, you agree to contact us at support@prismluv.com and attempt to resolve the dispute informally.

10.2 Binding Arbitration

If we cannot resolve a dispute informally, any claims will be resolved through binding arbitration rather than in court, except for small claims court matters and intellectual property disputes.

10.3 Class Action Waiver

YOU AND PRISM LUV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Governing Law

These Terms are governed by the laws of the United States and the state where Prism Luv is headquartered, without regard to conflict of law principles.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prism Luv
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• No Waiver: Our failure to enforce a provision does not waive our right to enforce it later
• Assignment: You may not assign these Terms without our consent. We may assign them at any time
